Case Spotlight

Partner Raquel Hecht has won numerous cases and notably she was counsel on a major victory in the Ninth Circuit Federal Court of Appeals that changes the way in which Immigration officials can use evidence against immigrants for their own deportation. In Tokatly v. Ashcroft the Federal Court found that in order to issue a notice of a deportation or removal hearing, the immigration judge must first find that the basis for the person's deportation, in this case a criminal record, must be clearly shown in the record of conviction. If the record does not show the actual conviction, the Court cannot rely on the testimony of witnesses or anyone else to remove the person. Click here to view published decision
